Joseph was the son of Obediah Payne and Jemima Oney.

Joseph married Mary "Polly" Stewart, 01 Apr 1801 in Knox Co KY. They had 12 children that I know of.

Joseph also had children with Jane Spencer, and I am not sure if they were married.

A paper purporting to be the last will and testament of Jo Payne was this day introduced as ______ _______ ______ by the oath of John Riley, Sr. and Henry Martin ___ ____ _____ witnesses then to ordered of record as follows: I Joseph Payne of the County of Knox and the state of Kentucky being of sound mind and disposing memory for which I think god and calling to mind the uncertainty of human life and being desired to dispose of all such worldly estate and hath pleased god to ___ use with I give and bequeath the same in the manner following _____. 1st I desire that all of the perishable part of my Estate be sold after my decease and out of the moneys amassing there from all my just debts and funeral expenses paid. 2nd I give and bequeath to my wife Jane Payne personal and real estate I might be in possession of at my decease or the moneys amassing from the sales of my Personal Estate after the debts and funeral expenses are paid as above to be used during her natural life for the maintenance of herself. 3rd After the death of my wife, Jane Payne, I will and bequeath unto my five sons namely James Payne, Wm Payne, Joseph E. Payne, Joel Payne, and Franklin Payne all the real estate I may have or hold any ____ to at my death to be equally divided between my five sons above named for their joint use and benefit _____ 4th To my daughters-Nancy Coleman?, Rachel Hignite, Mary Hughs, Eliza Bain, Agnes Parrot?, Amanda Randels?, Joanah Berry, Lucy Sampson, Elizabeth Laws?, Telitha Broughton, and Lydia Payne, I desire my five sons above named to pay one of my daughters named in this will the sum of ten dollars where the property bequeathed same shall pass unto their hands after the death of my wife Jane Payne. 5th All of the rest of my estate both real and personal _____________________not herein before particularly disposed of I desire may be equally divided between my five sons hereby before named which I give to them, their executors and assignees forever. And lastly I do hereby appoint my sons James Payne and Joseph E. Payne Executors of this my last will and testament hereby providing all within as forever will, as testament when of I herewith set my hand and affixed my seal this the 23rd day of April in the year of 1856. Signed, sealed, and delivered as use for the last will and testament of the above named Joseph Payne in the presents of us.
