Thomas was the son of Edward Upton, Sr. and an unknown mother. It's possible he could have been born in North Carolina, but Thomas' exact origin is not yet proven. His father is recorded as an indentured servant in Augusta County, VA until Dec 1770; having been brought to America in Aug 1763 aboard a convict ship.

Thomas married Ruth (Queen) Hambee, daughter of Henson Queen and Sarah Hampton, on 20 Aug 1789 in Rutherford County, NC. Performed by: William Monroe, Baptist Minister. Bondsman: William Queen. Witness: Issac Whiteside.

In Jan 1792, Thomas appears on a road jury as an able-bodied representative of his father, Edward Upton's household.

In August 1831 he and wife, Ruth (Queen) Upton are shown in a court case where they are sued for slander by Captain William Jones.

In Dec 1833, Thomas makes his Last Will & Testament. He appoints his son, Daniel as the executor of his estate.

In the June 1841 court term, an estate inventory is performed; his estate is probated that same year.
