Boggy Bend Cemetery

The City of Oklahoma acquired rights from the City of Atoka for a water supply on Lake Atoka. They claimed the right to close access to the county road leading to the lake and were sued by landowers who grazed cattle on 2200 acres leased from the City of Atoka.
The Oklahoma City won the right to partially close access to Boggy Bend Road which leads to the cemetery. They said plantiffs had no one buried in the cemetery and therefore had no right to complain. Also that a city has a right to protect a public water source.
They did agree to a styl on either side of a padlocked gate for pedestrain foot traffic and to give the plantiffs a key to the lock.
A funeral home director and workers hired by Oklahoma City were arrested and convicted in 1963 for digging up the cemetery without permits. Another explanation came out later that the county road lead to an existing fish camp on private property and that Oklahoma City wanted a competitor to have exclusive boating and fishing rights on Lake Atoka.
