Ever Been Denied Cemetery Access?
The Texas Historical Commission needs your help with a very important issue concerning access to historic cemeteries.
Under the existing Texas Health and Safety Code 711.041, access to cemeteries is granted to:
(a) Any person who wishes to visit a cemetery or private burial grounds for which no public ingress or egress is available shall have the right to reasonable ingress and egress for the purpose of visiting the cemetery or private burial grounds. This right of access extends only to visitation during reasonable hours and only for the purposes usually associated with cemetery visits; and (b) The owner or owners of the land surrounding the cemetery or private burial grounds may designate the routes of reasonable ingress and egress.
The Texas Funeral Service Commission has been given the authority to write rules under this section of the Health and Safety Code. We are asking if you know of any cases where access has been denied (locked gate, oral or written denied access by surrounding landowner, no response from surrounding landowner on route to the cemetery, law enforcement declines to get involved). Please provide a written description of the situation and send one copy to the Texas Historical Commission and one to the Texas Funeral Service Commission, O.C. Robbins, Executive Director, P. O. Box 12217, Austin, Texas 78711. This subject will be discussed at their next board meeting on June 17, 2008, so they need this information as soon as possible.

We actually live in Marshall and the cemetery is located right on the outskirts. My husband was born and raised here and knows the back roads really well. At the time the gentleman posted the info on how difficult it was to get back there, the Draco company was probably just beginning to work that area so they completely shut off access for the public's safety.
Yesterday the gate was wide open. At first glance you cannot tell that it is a cemetery. It just looks like an old yard. My husband saw a virgin Mary statue poking up and we got out! So fun!!! If you check the photos and names of the people i added, input a pic of the whole cemetery.

Champion Cemetery
I spent 2 hrs trying to find access to this cemetery. The last reference was when the Darco Mining company cut the access road to the normal entrance to the area. Since then, they have systematically fenced, gated and denied access from all access points. Unfortunately, it appears this cemetery, having not been photographed before, will be lost to Mother Nature and Father Time.

Champion Cemetery
On CR 3326 (Darco Rd), 2.6 miles west of the intersection of CR 3326 & Hwy 43. At the Cave Springs Church turn right. One half mile from the church you cross a creek and turn left. Follow this road 2.6 miles. At this point there are 4 mail boxes on the right side of the road and a drive that turns to the right. The cemetery is approximately 1/2 city block on the right side of the drive. It is about 200 yards from the drive. This was the old Champion home place.
It is a fenced area about 70 by 90 ft. and is badly overgrown. In some places weeds were over my shoulders. The stones are badly broken and for the most part unreadable.

Hubert Bender's note - June, 1998 - Seems to be active again
2 March 1996. The road described has been cut by Darco Mining. Now, you must stay on Hy 43 past the Darco Mining Office, turn right on Darco Road, about 2.5 miles, see intersection with Old Cave Springs Road, 4 mailboxes on right. Cemetery is about 100 yards off the road.
I apologize for using the above directions without permission. I did not know how to get permission from La Jean DUNCAN UPSHAW & Hubert BENDER.
